Like it or not, Sen. Jay Rockefeller’s new bill asks the right questions about online streaming television competition.
The SEC’s charge against the CEO of Netflix for a Facebook post illustrates that even government agencies that “get it” technically are often trapped in outmoded world views.
The marketplace is showing not that DVDs are being sold OR rented “too early,” rather that technological convergence is making more and more options available to consumers, so building a library of physical DVDs is relatively unimportant, and certainly no longer a priority.
It was bad enough with Amazon’s “one-click” patent, but now we’ve got insurance patents, order-processing patents and other patents for what are not inventions, but just ideas. Of course ideas are creative and deserve protection, but they should not be patentable.
